"We are not going to run the Preakness", West said.

A furore erupted when stewards disqualified victor Maximum Security for causing interference on the home turn, awarding the race to outsider Country House.

"We are going to file an appeal today with the State Racing Commission", said West.

Legal action over a Derby result does have precedent in the sport, with the 1968 Derby, when Dancer's Image owner Peter Fuller contested his apparent winner's disqualification after a urinalysis revealed a drug prohibited in Kentucky.
West has vowed to appeal the ruling with Kentucky's state racing commission. The resulting legal battle lasted four years before Forward Pass was ruled the official victor of that race.
